American College of Trial Lawyers supports Chief Justice McLachlin

In a press release published yesterday on the American College of Trial Lawyers website, its President, Robert Byman, “expressed the College’s full and unqualified support for the Chief Justice of Canada, The Honourable Beverley McLachlin. ‘We are deeply concerned about what we believe to be unjustified criticism of Chief Justice McLachlin relating to steps she took on behalf of the Supreme Court of Canada in the context of the anticipated appointment process of a new Justice from the Province of Quebec to the Supreme Court of Canada. The facts show that her actions were entirely proper and totally within the duties and responsibilities of her judicial office, and to suggest otherwise is an unwarranted attack upon the judiciary.'”
The pre-eminent College comprises litigation lawyers in both the United States and Canada. It is, of course, responding to the very public statements of Justice Minister Peter MacKay alleging the Chief Justice inappropriately contacted the government about a potential constitutional issue over the appointment of a Federal Court judge to represent Quebec on the SCC Bench. MacKay’s allegations have been widely refuted.
