SCC to hear age discrimination appeal

News on Thursday that the Supreme Court of Canada has agreed to hear an appeal of the age discrimination case, Michael McCormick v. Fasken Martineau DuMoulin LLP, will be of interest to many Lexpert readers.

A case description of last year’s BC Court of Appeal decision was published in the October, 2012 issue of the magazine.

According to McCormick’s counsel Murray Tevlin, who spoke to Canadian Lawyer’s Legal Feeds:

“The present state of the law is that if a firm organizes itself as a Canadian partnership, it need not concern itself about the human rights of its partners … We argued that this relationship [between McCormick and Fasken] looks and sounds just like employment and should be treated as employment just for the purposes of human rights.”
